Possession and licensing in Wales

Does failing to be licensed under The Housing (Wales) Act 2014 prevent a landlord from serving any notice seeking possession, or just a section 21 notice? That was the issue in a county court appeal in Evans & Evans v Jarvis, County Court at Swansea, 20 August 2019 (unreported elsewhere, I’ve seen a note of […]

When an ‘or’ is an ‘and’ in Wales

Evans v Fleri (2019) EW Misc 12 (CC) A lesson in drafting from Wales. The Housing (Wales) Act 2014 provides at Section 7(1) The landlord of a dwelling subject to a domestic tenancy must not do any of the things described in subsection (2) in respect of the dwelling unless – (a) the landlord is […]

Let’s all move to Wales …*

Yesterday, the Welsh Government published the Renting Homes (Wales) Bill.  The Bill seeks to implement the Law Commission’s Renting Homes Bill, with some major amendments partly reflecting the devolution settlement (ie what can be done) and partly to update the Bill.  There are also some rather interesting and slightly more subtle alterations in the Welsh […]

Let’s all talk about Wales

We don’t often publicise events here, but given that this one involves at least couple of the NL team, we are damn well going to. Let’s Not Move to Wales…

The Welsh Exodus Continues

We have had an ongoing series of posts about moving to Wales and at NL towers we have discussed whether we should be seeking advertising from the Welsh tourism authority! Before that comment causes a deluge of emails from unlikely legal service providers seeking to advertise, that was a joke and we do not accept […]

Let’s all move to … Wales

This is another one of our irregular posts on our theme of happenings in Wales; this time with an apology because it’s all rather later than I had hoped and SO much is going on in Cardiff that they must be in a state of permanent combustion.  Following on from the Welsh Government’s magnificent White […]

Let’s all move to … Wales

We have previously commented on various housing and homelessness developments in Wales.  These have been individual interventions into homelessness and the legislative competence order giving legislative housing powers to the Assembly.  Moves are now afoot to do something radical with housing.  In December 2011, Huw Lewis, the Minister for Housing, Regeneration and Heritage, published a […]

A very short note about Wales

As we’ve previously reported, the National Assembly for Wales has been seeking legislative competence over social housing and gypsy and traveller law. The Legislative Competence Order has now been approved and is available here. It came into force on July 22, 2010.
